The DEA intends to temporarily place 7-OH above a very low threshold — 1 milligram per package — into Schedule I. Before that happens, HHS is asking the public one narrow question: where should the line be, and how should it be measured? Specific, real-world input from adult consumers is exactly what they asked for.
Docket HHS-OASH-2026-0232 (91 FR 41049). The proposed threshold: botanical kratom material with more than 0.050% 7-OH by dry weight — or any processed product with more than 0.050% concentration or more than 1.00 mg of 7-OH total. HHS is collecting data on (1) what quantity of 7-OH actually constitutes a hazard and (2) whether the limit should be measured differently — for example, per labeled serving. Comments go on the official public record and are forwarded to the Attorney General.
